2. Platform Role and Disclaimer

1. Avenduer is a marketplace only. We do not buy, sell, rent, own, inspect, store, transport, or deliver any items listed on the Platform.
2. We are not a party to any transaction, agreement, or dispute between users.
3. We do not guarantee the quality, safety, legality, accuracy, or condition of any item listed.
4. All transactions occur entirely at the users’ own risk.

3. Listings and Content

1. Sellers are solely responsible for the accuracy, legality, and completeness of their listings.
2. Listings must not:
   • Be false, misleading, or fraudulent
   • Involve stolen, illegal, or unsafe items
   • Violate local, state, or federal laws
3. We reserve the unrestricted right to:
   • Review, modify, reject, or remove any listing
   • Remove listings without notice
   • Take action against users who violate these Terms
4. Listing review by our staff does not constitute an inspection, verification, or endorsement of any item.

4. Vehicle-Specific Acknowledgment (Bikes, E-Scooters, Mopeds)

1. Buyers are solely responsible for:
   • Verifying item condition and safety
   • Determining legal compliance, including licensing, title, registration, and insurance
   • Using proper safety equipment (e.g., helmets)
2. Laws and regulations vary by jurisdiction. We make no representations regarding compliance with local transportation laws.
3. Use of any vehicle purchased through the Platform is at the buyer’s sole risk.

5. User Conduct

You agree not to:

• Engage in fraud, misrepresentation, or deceptive practices
• Harass, threaten, or abuse other users
• Circumvent verification or moderation systems
• Use the Platform for unlawful purposes
• Scrape, copy, or misuse Platform content or data

Violation of this section may result in immediate account termination.

6. Messaging and Communication

1. Messaging is provided solely to facilitate user-to-user communication.
2. We are not responsible for the content of messages or user interactions.
3. We reserve the right to monitor, restrict, or disable messaging at our discretion.

7. Fees and Featured Listings

1. Certain features, including featured listings, may require payment.
2. All fees are non-refundable, regardless of outcome or sale.
3. Featured listings increase visibility only and do not guarantee a sale.
4. We reserve the right to modify pricing at any time.

8. Account Suspension and Termination

1. We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms.
2. Termination may result in loss of access to listings, messages, and account data.
3. We are not obligated to reinstate any account.

9. Limitation of Liability

To the maximum extent permitted by law:

1. Avenduer shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
2. We are not liable for injuries, accidents, theft, loss, property damage, or disputes arising from use of the Platform or items obtained through it.
3. Your use of the Platform is entirely at your own risk.

10. Indemnification

You agree to indemnify and hold harmless Avenduer, its founders, operators, and affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the Platform
• Your listings or transactions
• Your violation of these Terms

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated by reference.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles.
